We can't trust SCOTUS to give us liberty and self-governance
Convention Of States ^ | June 18, 2020 | Convention Of States

Posted on 06/21/2020 12:12:51 PM PDT by Nateman

By now you've heard about this week's decisions from the U.S. Supreme Court. Conservative Review's Daniel Horowitz sums them up well in a piece entitled, "Conservatives get massacred by fake 'conservative' SCOTUS":

Within 35 minutes today at 10 a.m. Eastern, what some thought was the most conservative Supreme Court of all time concocted a fundamental right to transgenderism in the context of labor law, erased the Second Amendment, and interfered with a state death penalty case, but declined to interfere with a California law that criminalizes law enforcement cooperation with federal immigration agents.

Taken in totality, the “conservative” legal movement, which has promoted the idea of “appointing better judges” rather than fighting the entire concept of judicial supremacism, has failed miserably. This was its Waterloo.

Whatever you believe about each individual decision, you can't deny that the Court has -- once again -- significantly expanded the power of the federal government. Rather than leave policies about employment and gender to local and state governments, they've effectively rewritten federal law to cram a policy down the throats of every American citizen nationwide.

By contrast, they have failed to settle the disputes around gun rights and the Second Amendment -- a provision, unlike gender, that can actually be found in the Constitution.

If you were hoping that Washington would fix itself, this should be your wake up call.

Washington will never limit its own power. The Court, no matter how "conservative," will never rule to eliminate judicial supremacism. Their rulings have the force of a constitutional amendment. Each decision proposes and ratifies a new amendment without the approval of the states and the people, and there's no recourse.

The only way to reverse these decisions is via another Court decision or a constitutional amendment. Since the Court will never reverse a 6-3 decision and Congress will never propose an amendment limiting the power of the federal government, the states and the people must take charge.

Article V of the Constitution allows the states to call a convention to propose constitutional amendments. These amendments, once ratified by 38 states, can limit the power and jurisdiction of the Supreme Court, impose term limits on federal officials (including justices), and mandate fiscal responsibility in Congress.

This is the only recourse left to We the People to restore the balance of power between D.C. and the states. We cannot let nine non-elected justices continue to dictate policy for all 330 million Americans. The Founders gave us a tool in Article V to end federal overreach, and it's time we used it.

...Everyone in D.C., no matter how "conservative" they are, believes that their job is of vital importance.

This is why Article V was put into the Constitution. They knew power would start to concentrate in the District of Criminals as the busybodies played the game of accumulating power. The belief that utopia is only one more law away shimmers before them even if it is only a mirage. The idea of simply maintaining the rule of law without tinkering is foreign to them.

This is why the ultimate power was given to the states thru Article V to strip away all that power in one bold stroke. It's like a revolution without having to shoot anybody!

Article V won’t work anymore these vile creature will hijack it!! Trump has the power to transfer whole department of government across the country and bust the whole damn DC SWAMP up!! This would also do away with K-Street lobbyists swarming the place!!

Article V won’t work anymore ...

Anymore? Did it pass without my knowing? Actually what the left is doing is getting states to undo their request. Nevada, New Mexico, Maryland and Delaware have over the last two years rescinded all official requests for a constitutional convention. The left is very worried so be of good cheer.

“Why not use the peaceful way out the Constitution itself offers?”

What way is that? Voting? Constitutional convention?

We are no longer ruled by the kind of freedom loving, God fearing people that our constitution was created by... We are ruled by a bunch of stinking elitist lawyers..

Thay own DC, they know it, and they're not about to give it up without a fight... :( Ask PDJT, he'll tell you..!

Article V is our last peaceful alternative.

President Trump now knows the Deep State extends not only throughout the administrative state, the military, and the judiciary, but to the scotus itself.

Once he blows Plugs away this November, I hope he realizes that unless he leaves behind reformed institutions, all of his successes will soon disappear.

So yeah, I think PDJT will support an end run around the hopeless corruption and push for an Article V COS. If his counsel is wise, they'll encourage re-federalization beginning with repeal of the 17th Amendment.

A long shot? Sure. So was 1776.

The Framers knew the nature of men. It’s why the counterpoise to the House was a Senate of the States.

The people wanted a Senate more congruent with the House, and they got it in 1913.

Our fate, the slide into Orwellian tyranny, is sealed until We the People reverse the horrid mistake of the 17th.

Sure, I believe there are hurdles that would have to be overcome for article v to work. I support it regardless before I support violent revolution or what some would call a civil war primarily because it would come with another set of challenges equal to or greater than that of article v.

In other words a civil war or revolution ends with some resolution of conflict leading to a agreement of both sides to restructure the govt a certain way or the birth of a new govt. That can be a very long and dangerous process with no knowing what we would end up with in the end at this point.

I believe that is why this country and it’s founding principles are worth fighting for. I even took an oath to do just that once long ago. That being said I can’t always see the path that we must follow in my mind at least. I am only a simple farmer who ponders these things at an amateur level at best.

I’m joining, and supporting, COS. I’m done trying to pursuede reps to do the right thing. The uniparty is hopeless and can’t fix itself. Not enough Trumps.

COS will give us term limits. That is the key step. The rest will follow. We need better people in Congress, not professional politicians.

“You do not want a Convention of the States. You can’t control the agenda.”

All they will do is propose amendments. The states still must ratify them. What’s out of control about that?

The way to move forward is Article V

The America that would ratify the Amendments your convention would adopt is dead and buried.

It's going to take a lot more than that to save our people.

My point was that nine robes wield disproportionate power over the legislative branch, the president and 330 million people, often for whimsical ideological reasons that torture the constitution. Are you OK with obviously biased judges exercising such enormous power over us?

The people speak. Our elected representatives cast legislation. Our elected president executes and enforces the laws. But the Supreme Court at times ignores and overrides the authority of the other two branches.

This is not the system the Founders intended. It is madness. Just look at the harm this abuse of power has caused in this country. The recent DACA decision was a disaster. It effectively allows a president to create binding legislation without a single vote from congress. And this is just one of a long string of equally bad decisions that are eroding our constitution.

The Supreme Court is nothing but a glorified kangaroo court that is wrecking this country. Its no wonder people are losing faith in our system.

America’s robed mullahs are so much more nuanced than the ME morons.

Collectives R us. They’ve destroyed law. It was a 5-4 decision.

there would be “justice” if you were
an Epstein Island bro
of “Judge” Roberts (Epstein Island, Malta)
OR were involved with giving him children and
his adrenochrome needs.

HE SHOULD BE IN GITMO.
