Full title:

So long Roe vs. Wade? President Trump's most lasting legacy could be radical change at the Supreme Court

The election of Donald Trump as president means that there will be a conservative Supreme Court for years and maybe decades to come, but how much the court will move to the right depends on the health and stamina of Justices Ruth Bader Ginsburg, Anthony Kennedy and Stephen Breyer.

From 1971, when Richard Nixon’s third and fourth justices were confirmed, until February 2016, when Justice Antonin Scalia died, there have been at least five and sometimes as many as eight justices appointed by Republican presidents. Today, there are four justices appointed by Democratic presidents and four appointed by Republican presidents. Chief Justice John Roberts, Justices Clarence Thomas and Samuel Alito are the most conservative; Republican nominee Anthony Kennedy is a swing vote. Ginsburg, Sonia Sotomayor and Elena Kagan are reliable liberals, with Breyer more the centrist.

That lineup won’t change right away. Even if Trump nominates Scalia’s replacement soon after his inauguration on Jan. 20, the process of vetting and hearings means that the court will not have a ninth justice as it hears oral arguments through April.

What happens to the court in the long term depends on when future vacancies occur. Since 1960, 78 is the average age at which justices retire. Scalia was 79 when he died on Feb. 13. There are three justices 79 or older. Ginsburg turned 83 in March. Kennedy turned 80 on July 23. Breyer turned 78 on Aug. 15.

Can these three justices remain on the court until Jan. 20, 2021, assuming that Trump is a one-term president? That will depend on their health and their ability to continue to function at the very high level required of a Supreme Court justice.

I think we need to keep the supreme court busy busy busy. make those justices burn the midnight oil. No rest for the weary.

Trump is going to get I think 2 picks. 3 if he wins 2020.

So, Trump will be able to make a nominee right away in his presidency, won’t he?

I know he has a list; I wonder if any of the names are more likely to be selected?

Start vetting now! And Jan. 21st is only a tradition, time to push that back to the first week of January at the very least. No one is having to travel by horse to get to D.C. nowadays.

"Trump is going to get I think 2 picks. 3 if he wins 2020."

He'll win 2020 if the two are good.

You want to scrape out the contents of your womb, well, sadly, I can’t stop you. But I’m frickin’ tired of seeing federal dollars go towards funding this evil which thereby subsidizes the irresponsible behaviors that lead to it.

Defederalize it ...you want an abortion, YOU pay. NO more abortion/government conglomerate. Let the abortion “industry” stand on its own.

The big question is whether Ruth Buzzi Ginsburg is now so disheartened by the reality of President Trump that she loses her will to live, or whether she is so evil that she will simply never die.

If roe vs wade ended? Perhaps not. But at the very least clinics must be held to the standards of medical surgery suites in regards to staffing credentials, sanitation, etc... Planned Parenthood is out of the abortion business and subsides (taxpayers money) be discontinued immediately. Actual counseling rather than funneling... etc... etc... conflicts of interest with government officials and family members halted... so on & so forth.

Barber shops and hair salons have more stringent criteria to meet!

>>Chief Justice John Roberts, Justices Clarence Thomas and Samuel Alito are the most conservative<<

Tsk tsk, the MSM hasn’t learned its lesson. They still list Roberts as Conservative (HA!)

If I were Trump, I’d nominate the oldest, sickest, most left-wing extreme black latino LGBT feminist and America-hating baby killer I could possibly find to the Supreme Court, so that when she died a month later, I could replace her, the Left’s new favorite Supreme Court justice, with the youngest, richest, white male-chauvinist rightwinger, hunter and climate skeptic I could find who could bench press 500 pounds and who adamantly refused to get any of his dozen 500hp daily drivers smogged or muffled, just so I could watch a million leftist tards stroke out and drop f’n dead of heart attacks.

You don’t need to wait for a judge to repeal Roe vs Wade. Defund it. Remove it from health care. Regulate it. Show what happens in an abortion on TV.

It will die.

I’m convinced within the next 4 years Roe v Wade will be evicscerated!

I had lost hope of seeing it happen in my lifetime.......

.....but hope springs eternal!

Who could have imagined a President Trump......Thank you God!

Roe v Wade will most likely not be changed.
The history of the SCOTUS is to maintain consistency and not change opinions already issued.
There have been few times where the court has reversed a ruling, Dred Scott being the most notorious

A liberal PhD who cannot do simple logic.

The author tells us there are three justices who are 79 or older, then says one of them is “Breyer turned 78”. 78 is not 79.

A small point, but it shows the lack of care for facts.

A replacement for Kennedy would be nearly as good.

Kennedy might well be willing to retire.

Trump’s election looks to be an answer.

What is left out of this story (in general) is that even if the Supreme Court OVERTURNS Roe Vs Wade, all that happens is that the decision / control reverts to the individual STATES as per the FEDERALIST doctrine. The concept that this was an issue available for Supreme Court decision was based upon a truly tortured reading of the ‘penumbra’ of implied privacy.
