Statutory rape victim reportedly forced to pay child support

PHOENIX — A man who slept with a 20-year-old woman when he was 14 — and didn’t learn he was a father until eight years later — is now being forced to pay child support, the Arizona Republic reports.

Olivas, who said he was confused and going through a rough patch at that time of his life time, said the two went their separate ways after the encounter.

Arizona law says a child younger than 15 cannot consent to sexual relations with an adult under any circumstance.

All of it was put behind him, he thought, until two years ago he was served papers from the state demanding he pay child support.

Oh, sure. NOW he saying he was "confused," AFTER the papers have been served. Back then he was probably bragging about it to everyone he could.

You’re just being a douche as a joke, right? Would you make the same statement if the victim of the rape was a young girl? And if not, why not? What’s the difference? So you really believe that a young boy who was raped should now be forced to pay child support?

Well as Dad said, "You screw up, it's your baby."

He should get a DNA test, and confirm it's his. But if it's his child, he should pay child support and have visitation rights.

Your point? If this was a 14 year old girl you would be demanding the head of the 20 year old. You are right he probably did brag but what boy wouldnt? It does not make what happened right.

Are you people high? Did you read the article? He was FOURTEEN and she was a 20 year old adult! And you think that child support should be awarded to a rapist?!

Doesnt matter in AZ. All she had to do was put his name as the father on the birth certificate here and its legally his.

He should sue for FULL Custody! She is obviously an unfit mother, she is a child molester who raped an underage boy! Not to mention the fact that she hid the child from her rightful father! Goose/Gander I say!

Well they should give him custody and let her pay the child support. But if he doesn't want custody, then he's still the father. The courts take the position that the child needs to be provided for. It's about the child not about him or her.

It was statuatory rape, but unless she forced him, it was still his decision, even if he was only 14.

Why would the VICTIM of a RAPE have to have a “cop-out” in the first place. Or do rape laws only apply to male perpetrators?

Arizona is paying her, AFDC I suppose, and whatever other benefits she can claim, and they want reimbursement from the father. He’s the father.
But he was a minor and Arizona chose not to pursue her, even if he “failed to file charges”. Rape of a minor under a certain age is by statute a crime (”statutory rape”, sexual assault, whatever you want to call it) so the kid could argue that since the state let him down, by refusing to enforce AZ law, the state is barred.
If he didn’t waive a defense by ignoring legal notices. There’s enough stupid here for everybody to share blame.

BULLS**T! Children under a certain age don’t have the right or ability under the law to consent to sex with an adult or every paedophile from Bakersfield to Bangor would be at a used care lot right now, pricing panel vans! We abort over a million babies a year, don’t give me this “it’s about the child” hogwash.

The article is not clear. It says he initially ignored the request for child support and now owes penalties. But it also sounded like he was being forced to pay back child support for the period of time he didn’t even know he had a daughter.

He shouldn’t have to pay any child support for the period of time in which she didn’t even tell him he had a daughter.

Agreed, then prosecute her for statutory rape. And give the child to him. And she can pay child support when she gets out.
