Everyone I know here who muzzleloads is going after deer at shorter range than rifle season, That's the general plan with my gang of nimrods too , but to paraphrase JFK ,there is always some poor dumb son of a buck deer who does not get the word .

Crimes based on negligence are a cans of worms and subject to both prosecutorial abuse and political favoritism , sometimes even based upon who was struck . Look at the definitions for negligence in your criminal and motor vehicle codes as to what constitutes a felony or a misdemeanor and often you will find distinctions without differences .
