Hugh's been strong in defense of Terri -- till yesterday, when he devoted a lot of time denouncing those (like Dr. James Kennedy) who have called for Jeb to step forward - despite Judge Greer's injunctions - and take action to save Terri Schiavo from a judicially-decreed death.
Hugh was going on about the "rule of law" and quoting the old chestnut from "Man for All Seasons," about how if we tear down the laws to get at the devil, we have nothing to defend ourselves when he turns on us.
But Hugh doesn't get it: IT's the ACTIVIST JUDGES who've ALREADY TORN DOWN THE LAWS. For some politician to stand up to a lawless judiciary would be a stand FOR the "rule of law," not against it.
We have a crisis of governance in this country, with judges taking seizing tyrannical power. Tthey're able to act as tyrants only because elected officials won't stand up to them. IF THERE WAS EVER AN OCCASION THAT WOULD PROVIDE AN OPPORTUNITY TO TURN THE TIDE - FOR AN ELECTED OFFICIAL TO SAY "NUTS" TO A DICTATORIAL JUDICIARY - IT IS NOW, WHEN THE TINPOINT JUDGE GREER, A HICK COUNTY JUDGE SWOLLEN WITH ARROGANCE HAS ORDERED AN INNOCENT WOMAN KILLED SIMPLY BECAUSE SHE'S dISABLED.
There are constitutional and statutory provisions enough for Jeb to rely on, as chief executive authority of Florida, to act to save this woman.
Hugh Hewitt, with all his civics lecturing -- taking the issue away from the life or death realities of this crisis -- forgot to mention some important historical precedents: Lincoln refused to obey the Dredd Scott (pro slavery decision); Andrew JAckson scoffed at what he considered an illegal order of Chief Justice John Marshall; Thomas Jefferson affirmed that EACH BRANCH of government has an independent DUTY to interpret and UPHOLD the constitution;;; and DWIGHT EISENHOWER SENT TROOPS TO CLINTON'S ARKANSAS (clinton was a kidk, of course)., when local politicians AND LOCAL JUDGES WERE IMPOSING SEGREGATIONIST LAWS, DENYING BLACKS THEIR RIGHTS TO EQUAL PROTECTION - i.e TO GO TO UNIVERSITY.
The showdown with arrogant judiciary has to happen at some point: Destiny has asked Jeb to be the hero for free government, and to take a stand. Hugh Hewitt counsels passivity: Let's hope Jeb finds the counsels of conscience to be louder and more persuasive!
Terri is bleeding by the tongue. Jeb Bush, Hugh Hewitt and the rest of should say "NO MORE!" to Mr. Greer, the judicial mediocrity who has ordered that torture.
The Governor of Florida allowed his office and leadership be usurped by a judge. He will never recover his credibility. He has displayed himself to be of feeble character. Too bad it was at Terris expense. When called upon to lead, he coward.
The buck stops at the Governors office and not with some judge.
Difficult question and to be fair, only one that Jeb Bush can answer.
I'm very upset by all this and I see the struggle with Jeb Bush fighting for Terri and I'm not about to judge him harshly now.
Hugh is a coward. He always has been. Real men don't listen to spoiled brats.
Hugh does get it and knows activist judges are the problem. He believes that violating the law ourselvesis not the proper way to remedy the problem. The way to go is to elect the right judges, or, where they are appointed, change the balance in legislatures in order to get more conservative, strict constructionist judges on the bench.
Hugh DOES get it. I have been appalled at the way people here have demanded that the law be ignored.
No good deed goes unpunished.
Jeb Bush will be the new lightning rod
unless Terri rises from the dead.
But they won't take the time to explore the WORK he has done on Terri's behalf.
Jeb Bush has been fighihg endlessly for years now, trying to effect change, through policy and intervention on this poor woman's plight.
So has Right to Life.....behind the scenes...lobbying the Florida legislators and actually getting bills passed...
..Already, in the past, Jeb Bush has been instrumental in giving this woman more time.
I am personally ashamed of those who are foaming at the mouth and wishing him ill will.
We are eating our own...
..Do you think Reno, or Bob Graham, or Lawton Chiles or Clinton's Congress or anyone of that ilk would have lifted a finger to help her.
The answer is NO!--No, they wouldn't....and NO they didn't!
PLEASE step back and see what is happeing.
The Democrats are in glee watching folks turn on Jeb Bush and by proxy, his brother, the President, because they didn't 'do enough'..(according to some people)
If you all are taking the word of Randall Terry on this.....PUUULLLLEEESS DON'T!...
Randall Terry has his own checkered past and has fallen from grace in many circles.
It just shows the desperation of Mr. Schindler to acquire the services of Terry.....I don't blame Schindler, but IMO R.Terry is taking a huge advantage of him just so Randall can get some face time.
I have great respect for D.James Kennedy, but not having read yet what he said, I still support Jeb Bush.
PLEASE FOLKS....STOP THE ASSAULT ON BUSH!
Why do you say that and what facts do you base it upon?
No, we've become a nation of judges who disregard the law -- and of wimpy politicians who won't stand up to them (and sheeple who give the wimps a pass - if they have an R after their names).
Greer is killing Terri. Jeb should do something about it. He won't, and he's counting on sheeple like you to make excuses for his inaction.
I heard that yesterday too. Medved was a little disappointing too. He's definitely for keeping Terri alive too, but doesn't think that Michael S. is such a bad guy--just doing an evil thing in this case. He said that Michael S. took care of her after her accident. From what I gather that was all for show--to show what a loving husband he was for the mal-practice trial because didn't it all end right after he got the dough?
Do judges have the last word as to what the law and constitution are ---for the Governor-- in his capacity as executive?
__________________________
Yes, but are we a nation of Judges too? Does the executive have no role in enforcing the law--or is he only an instrument of the Judiciary? What is the answer???
Hugh's arrogance about the law is appalling. To hear the legal mumbo jumbo that passes for the "rule of law" after reading the clear intent of the founding fathers is something everywhere present today. About the only courage Hugh has is to say we need to get better judges on the bench a process that will save a few people from being killed like Terri in about 50 years. Judicial corruption and tyranny has run amok for 40 years and old Hugh is still in the "who will decide if we don't let criminal judges decide mode" when push comes to shove. We are a nation of the attorneys, by the attorneys and definitely for the attorneys. CASE CLOSED... Terri will die and you could be next under "the rule of law(yers)"
He would have defended the "rule of law" in Germany in 1935, as doctors were euthanizing the "useless feeders," because judges had approved the new laws.
I'm not saying I really fault those who want him to do more, but I think they should realize that they will need his aid again, and that they shouldn't burn bridges. This is a tough one. Jeb has been great. We should be thanking him. This is NOT his fault.
Think about it, if we allow the law to be destroyed just in this one instance, it will never be put back together again. The law must be obeyed or changed but never ignored.
Yep - there are too many people here blind to the slippery slope.
