As a matter of undisputed historical fact – and as noted by Publius Alexander Hamilton in Federalist 68 – the Founders viewed the potential for the insinuation of “foreign influence” into the highest office of the new Republic with great suspicion and trepidation.    Federalist 68 confirms the Founders’ determination to prevent this danger, stating that it arose “chiefly from the desire in foreign powers to gain an improper ascendant in our councils.  How could they better gratify this, than by raising a creature of their own to the chief magistracy of the union?” (Emphasis added).  The objective was to shield and vigorously protect the “chief magistracy” – the Office of the President – from that potential.  Accordingly, the Founders sought to establish the highest possible available barrier to that danger by mandating, as John Jay had “hinted” to George Washington, that the presidency be restricted to not merely a “citizen” –  as Alexander Hamilton himself had once proposed, which the Founders ultimately rejected as being too weak – but instead to a “natural born Citizen.”  The highest available and known nbC definitional barrier in existence in 1787 was the de Vattel § 212 definition: a person born in the country to two parents who were already its citizens.

Article. II.

Section. 1.

The executive Power shall be vested in a President of the United States of America. He shall hold his Office during the Term of four Years, and, together with the Vice President, chosen for the same Term, be elected, as follows

Each State shall appoint, in such Manner as the Legislature thereof may direct, a Number of Electors, equal to the whole Number of Senators and Representatives to which the State may be entitled in the Congress: but no Senator or Representative, or Person holding an Office of Trust or Profit under the United States, shall be appointed an Elector.

The Electors shall meet in their respective States, and vote by Ballot for two Persons, of whom one at least shall not be an Inhabitant of the same State with themselves. And they shall make a List of all the Persons voted for, and of the Number of Votes for each; which List they shall sign and certify, and transmit sealed to the Seat of the Government of the United States, directed to the President of the Senate. The President of the Senate shall, in the Presence of the Senate and House of Representatives, open all the Certificates, and the Votes shall then be counted. The Person having the greatest Number of Votes shall be the President, if such Number be a Majority of the whole Number of Electors appointed; and if there be more than one who have such Majority, and have an equal Number of Votes, then the House of Representatives shall immediately chuse by Ballot one of them for President; and if no Person have a Majority, then from the five highest on the List the said House shall in like Manner chuse the President. But in chusing the President, the Votes shall be taken by States, the Representation from each State having one Vote; A quorum for this Purpose shall consist of a Member or Members from two thirds of the States, and a Majority of all the States shall be necessary to a Choice. In every Case, after the Choice of the President, the Person having the greatest Number of Votes of the Electors shall be the Vice President. But if there should remain two or more who have equal Votes, the Senate shall chuse from them by Ballot the Vice President.

The Congress may determine the Time of chusing the Electors, and the Day on which they shall give their Votes; which Day shall be the same throughout the United States.

No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty five Years, and been fourteen Years a Resident within the United States.

In Case of the Removal of the President from Office, or of his Death, Resignation, or Inability to discharge the Powers and Duties of the said Office, the Same shall devolve on the Vice President, and the Congress may by Law provide for the Case of Removal, Death, Resignation or Inability, both of the President and Vice President, declaring what Officer shall then act as President, and such Officer shall act accordingly, until the Disability be removed, or a President shall be elected.

The President shall, at stated Times, receive for his Services, a Compensation, which shall neither be encreased nor diminished during the Period for which he shall have been elected, and he shall not receive within that Period any other Emolument from the United States, or any of them.

Before he enter on the Execution of his Office, he shall take the following Oath or Affirmation:—”I do solemnly swear (or affirm) that I will faithfully execute the Office of President of the United States, and will to the best of my Ability, preserve, protect and defend the Constitution of the United States.”

Section. 2.

From Cornell Law School

“A natural born citizen refers to someone who was a U.S. citizen at birth, and did not need to go through a naturalization proceeding later in life. Under the 14th Amendment’s Naturalization Clause and the Supreme Court case of United States v. Wong Kim Ark, 169 US. 649, anyone born on U.S. soil and subject to its jurisdiction is a natural born citizen, regardless of parental citizenship. This type of citizenship is referred to as birthright citizenship. One can be a citizen while not being a natural born citizen if, for example, that person gained citizenship through the process of naturalization.

In some rare cases, a person born within the United States may not be a citizen if that person is not subject to U.S. jurisdiction. In Wong Kim Ark, the Supreme Court identifies two specific examples of people not subject to U.S. jurisdiction:

Children born of alien enemies in hostile occupation
Children of diplomatic representatives”

nope, no Trump kids except Tiffany would be eligible. I don’t know that most of the kids think like their father about the USA anyway, so why would we assume any would be great in a govt position?

so if some one commits an act against our constitution we just throw out that part? oh well that part can’t be enforced ever again? kinda stupid way to look at a country’s documents.

Sure obama will face judgement, if not soon, eventually he answers to the God who our Founders relied heavily on when they crafted the document Obama ignored.

The Constitution does not define ‘Natural Born Citizen’, so there is not much to go on from that aspect.

The Constitution says this about citizenship:

“All persons born or naturalized in the United States and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.”

The phrase ‘subject to the jurisdiction thereof’ rules out citizenship for children of diplomats for example. For almost all others, anyone born on U.S. soil automatically becomes a citizen.

Can anyone cut and paste language from specific judicial decisions that rules out someone like Haley becoming President? Something in black and white?

The whole house of cards relying on vague interpretations of various court rulings stacked on top of each other don’t count for much IMO. Just post some clear court ruling that specifically rules out Haley being eligible.

What a crock of crap! There is NO DIFFERENCE between a 14th Amendment citizen and a Natural Born Citizen. If Haley, who I think is a warmongering twit, was a citizen at birth, she is eligible.

There was SCOTUS case, Wong Kim Ark, which held that the 14th Amendment was simply the embodiment of older law on natural born citizenship.

This ain’t hard. My BFF explained it in simple English:

I picked some items that Trump has either walked back on his stance as POTUS or has not wanted to pursue as detailed in any policy statement or future thoughts on addressing. A few examples listed in my response - including his campaigning on ‘throw her in jail’ or any kind of budgetary control while president.
Just wondering what people think we are going to get with Trump - I feel the people want payback more than he does at times - doesn’t seem like he does that kind of stuff (payback). Probably why he depends on others to do the deep thinking in dealing with corruption - you would think he would be aware of all the persons of interest when it comes to corruption. His actions by appointment do not seem to indicate that he does.
