Washington (CNSNews.com) - Cecilia Munoz, the White House director of intergovernmental affairs, compared the federal crime of being in the country illegally to jaywalking."If you were running the police department of any urban area in this country, you would spend more resources going after serious criminals than after jaywalkers. DHS (the Department of Homeland Security) is doing the immigration equivalent of the same thing," Munoz told the Congressional Hispanic Caucus Institute (CHCI) conference on Monday.

If you are caught jaywalking, at a minimum you should have your backside hauled back to the side of the street you started on and have to wait until legally allowed to cross.

A quick look at Title 8, Section 1325 of the U.S. Code shows this to be false: Illegal entry into the United States is a misdemeanor on the first offense, and a felony afterward

The penalty for “Jaywalking” INTO Mexico is 3 years incarceration in a ‘hell-hole’ of a jail .
That is like calling “Fast and Furious” a shopping trip to Target for pesticide .

TITLE 8 > CHAPTER 12 > SUBCHAPTER II > Part VIII > § 1325 (Improper entry by alien) (b)(b) Improper time or place; civil penalties
Any alien who is apprehended while entering (or attempting to enter) the United States at a time or place other than as designated by immigration officers shall be subject to a civil penalty of (1) at least $50 and not more than $250 for each such entry (or attempted entry); or
(2) twice the amount specified in paragraph (1) in the case of an alien who has been previously subject to a civil penalty under this subsection.
Civil penalties under this subsection are in addition to, and not in lieu of, any criminal or other civil penalties that may be imposed.

Being present in the U.S. following an illegal entry, or after overstaying a nonimmigrant visa, generally is not a criminal violation, but rather a civil immigration violation.
She's weaseled her way around saying it's a criminal offense.
