You Can Try To Repeal The Second Amendment, But You Can’t Repeal History
The Federalist ^ | Harsanyi

Posted on 03/28/2018 12:46:15 PM PDT by pabianice

Whether repeal of the Second Amendment is feasible or not, historical revisionism is meant to mangle its meaning into irrelevancy. Stevens claims that his conception of gun rights is “uniformly understood,” yet offers no legal precedent to back the contention up. Stevens claims the Second Amendment’s explicit mention of “the right of the people” does not create an “individual right” despite the inconvenient fact that other times the term is mentioned — in the Fourth, Ninth, and 10th Amendments — they have been found to do exactly that.

The collective theory is modern invention. Even the picture of a musket and AR-15 juxtaposed above Stevens’ column to illustrate the antiquatedness of gun rights in the modern age misjudges history. Just as the First Amendment protects modern communication and just as the Fourth Amendment applies to modern forms of search, the Second Amendment extends to guns that were not in existence at the time of the founding. Unlike contemporary liberal columnist who’d like to revise the Constitution, the Founders were well aware that the fleeting emotions of the population could corrode rights.

But if you think the Second Amendment antiquated, that’s fine. Repeal it. The history of the Second Amendment, though, doesn’t change to comport with your contemporary positions.

As has been stated before....

Illegal isn’t synonymous with unavailable.

Secondly, do they think that we will just surrender them?

Not really sure how something that guarantees the right not to be infringed as, far as being armed, is "repealable" in the first place. Of course "they" can make owning and possessing a pain, but, repeal, I think not. Thankfully we have control of house, senate and White House. No, really. 😹😰😹😰😹😰⚖💸🏁🇺🇸

Majority support for the 2nd amendment in 13 lightly populated Western and Southern states - not to also mention Texas and Georgia - is IMO an impossible barrier for any repeal to overcome.

If they want to criminalize gun ownership by repealing the Second Amendment then they’re going to have to repeal Article I, Section 9, Clause 3 relating to ex post facto laws as well.

The right of self-defense is a pre-existing one. This fundamental human right is the most basic of all. How can one claim they are for the rights of minorities? There is certainly no better example of a minority than a single person, correct?

And that boys and girls, is the dirty little secret of “progressives”. They DON’T care one whit about “Minorities” except and insofar as they can be USED for their own purposes, for their own raw acquisition of power. Consequently you are NOTHING unless you are on their team. Notice that women aren’t really women, UNLESS they are liberal democrats. Blacks aren’t really black UNLESS they vote democrat.

While whites in general haven’t been officially declared illegal, simply voting democrat is no longer enough to keep the nutcases at bay. The hope was the alligator would eat them last, but that won’t work.

Progressives somehow screwed the pooch here, the timeline is way off. The Nazi-communo-fascist-totalitarian-authoritarian-socio-peoples-republic model of takeover sez ya gotta disarm everybody FIRST, then demonize them and haul them off to the gulag concentration camp.

As a normal American I am demonized in ever greater frequency and hysteria at every turn, in the media, in the news, and academia year after year after year. I’ve seen this movie before. I realize that the institutions and people therein whose duty it is to protect everyone regardless have been corrupted, and will follow orders no matter what they are. Including doing what they shouldn’t, not doing what they should, etc. So be it.

Don’t expect any quarter when the time comes. You mistook my forbearance for weakness you fucking bastards.

You can try to repeal the Second Amendment, but you’ll only kick off the 2nd Civil War.

Soon enough, Nature will ensure that Stevens will be arguing before The Highest Judge the case for his craven attempt to take their means of defense from the weak and downtrodden. I suspect that will happen before the 2nd Amendment is repealed in the United States.

The story of the repeal of the 18th Amendment by the 21st is an interesting one. Prohibition was universally unpopular & its enforcement woefully ineffectual, but there were vested interests in several states who wanted the U.S. to remain dry. They controlled state legislatures & would have rebuffed ratification of the proposed repeal.

For that reason the alternate Constitutional route to ratification was used. Here is a Wiki quote:

“In February 1933, Congress adopted a resolution proposing the 21st Amendment to the Constitution, which repealed both the 18th Amendment and the Volstead Act. The resolution required state conventions, rather than the state legislatures, to approve the amendment, effectively reducing the process to a one-state, one-vote referendum rather than a popular vote contest. That December, Utah became the 36th state to ratify the amendment, achieving the necessary majority for repeal.”

Now...controversy would raged on over letting the states choose to go wet, but there was tremendous popular support for repeal.

That will not be the case if a bill to repeal the Second Amendment actually passes in Congress with a 2/3rds majority. Insurrection & possibly civil war would result if such a bill were ratified and enabling legislation passed in Congress. The political atmosphere will be one of war between the states as liberty loving red states square off with gun grabbing blue states. Interruptions of transportation and communications along with interdiction of interstate commerce are not unlikely outcomes.

If they try to repeal the 2nd, they will discover what it was for in the first place.

And PA as well. My point was how small a segment of the US population could block any repeal attempt.
