So I am in my local Podunk town this AM.
Running errands etc. One the post office.
I am at a 4 way stop and look over to my left and see a mail box on the opposite side of the road, my side of the intersection. Good deal.
There is no on coming traffic or from any other direction or coming up from behind. I am alone in the intersection.
Throw it in park jump out (door open),run to the box deposit mail,run back put er in D and go through a still empty 4 way stop.
Cop pulls up from behind pulls me over and gives me a 92.00 tkt for, Improper parking. Said I should have pulled into a parking space to use the mail box.
Walked away and said ,"Have a Better day".Not a good day, a better day. He knew he as being an a-hole.
I am think about going to court. Wasnt parked was standing/stopped. I think the mail box is an entrapment set up. Maybe put there by Russians?
If you just pay them, it encourages the government ticks.
A good citizen's duty is to make it as revenue-neutral as possible. :)
You would then have to pay court costs.
I live outside a real small town. Country, as they say. Most of these infractions are to raise money for the city coffers. Not much else going on in small towns to raise money, except taxes. It's part of the deal.
Building permits, licenses, fines, etc., are all just to fatten up the town cash register. Fact of life. Cost of doing business.
Don't go the "pennies" route. Makes the guy look juvenile and it's a big pain in the ass to get 9,200 pennies into city hall. :-)
You can roll the dice if you wish.
I was cited for Reckless Driving many years age when I got my wife’s car stuck in a paved city creek bed. It’s a long story.
I took it to court. Paid $350 to a lawyer who arraigned a visit with the Assistant DA. As the DA was looking at the police report he suddenly blurted out “You were in a creek?” I said yes.
He wheels around in his chair and grabs the thickest book I’ve ever seen (before or since). He flopped it on the table, opened it near the middle and started flipping through pages, reading. I tried to read the pages myself, however the book was upside down to me and I simply couldn’t keep up with the DA.
Suddenly he slaps the book closed and yells “Dismissed!”. I mentioned I didn’t want to complain, yet I asked if he could explain his conclusion? He said in order to be cited for Reckless Driving you have to be within 75’ of a roadway. Since I was 350’ away the Reckless citation didn’t apply. He said there was a whole host of citations that would have, but Reckless wasn’t one of them.
I left the courthous singing in my best Bobby Fuller voice, “I fought the law and I won, I fought the law and I won . . .”
Preying on citizens to “fatten up the town cash register” is obnoxious.
He broke the law. A good citizen doesn’t park his car in the middle of the road. Sometimes the government isn’t a being a tick, sometimes they’re punishing an idiot for being an idiot. And anybody that parks in the middle of the road is DEFINITELY an idiot.
Get on the ball and elect a pro-2nd amendment, constitutional sheriff in your county. I have one, and he tossed two petty police chiefs out of the county who were harassing citizens.
You gotta be pro-active to protect your liberty. Only you can protect you from left wing fascists.
Not really. But that one reply was such hyperbole there was no way I could take it seriously. If it was serious, obviously I strongly disagree with that solution.
hyperbole is their middle name here
But that's the way it is.
I’m amazed that your car stalled and then you could restart it
If you got the time, go to court, plead “not guilty” and ask for a prosecutor’s pre-trial. Tell the prosecutor what the circumstances were and he may just drop the charge or amend it to a “call of the prosecutor”
The cop will probably show because either: a) he’s already working or b) it’s overtime.
And...if you have the time to go through all this, you had time to park the car originally.
Pay it in pennies
Depends on where I am.
C'est dommage
All patriots fight all tickets. If everyone who got a ticket actually went to court to fight it, this ticket crap would stop.
Prepare your case to the best of your ability, I would suggest actually going to traffic court a few times before your hearing to see what the judge is like and how things work in the courtroom. Most people who show up to fight their ticket haven’t given their matter more than five minutes of thinking. Do a better job.
It’s possible your cop won’t show up. Your ticket should be dismissed if that happens.
If the cop does appear, present your case, and if you win, great! If you lose, your fine should be no more than what is stated on the ticket. Be prepared to ask for the fine to be lowered. If you think of something you want to say, don’t hold back, but do not interrupt the judge and be polite always. Be prepared to ask for anything you want.
Be a patriot. Fight the ticket and win!
The light caught me -- and there were no other cars around -- so, I put the car in park and ran back and rescued the flag. After I got back in the car, I still had to sit for a long time, and had time to think: "What if a cop saw me?"
1) The town is solidly conservative, as is its PD
2) Only a liberal would ticket me for rescuing the flag.
3. The probability of getting both a liberal cop and a liberal judge in that town was slim.
4) I should have gone through that analysis before I left my car running in the center of the street!
But I got away with it... '-)
~~~~~~~~~~
OTOH, I was patriotic -- but you were lazy -- and you got bagged...
Pay up! '-)
You sought comments.
STET... '-)
