A Huntsville man doomed by his own testimony, according to his lawyer, was convicted today of raping a woman passed out in the bathroom during a Fourth of July party last year.
Jason Scott McNeal, 36, was convicted of first-degree rape - having sex with a person unable to consent because they were physically helpless or mentally incapacitated - after the jury deliberated for more than two hours.
McNeal's father testified on his son's behalf, telling jurors the younger McNeal was not a violent person. But his claim was likely undermined for the jury after McNeal's father admitted on cross-examination that his son had shot him in 2001.
Madison County Assistant District Attorney Tim Gann said the victim in the case didn't remember much of the incident, which occurred during a Fourth of July block party on O'Fallon Drive in Huntsville in 2013.
She had too much to drink, Gann said, and went to a nearby house because she wasn't feeling well. She went into the bathroom and threw up, then passed out on the bathroom floor, Gann said.
A friend of hers came by looking for her a little while later, according to testimony, and she saw through the partially opened door that the victim was passed out in a pool of vomit and McNeal was having sex with her.

Larry’s Good Conscience v. Larry’s Evil Conscience. A hilarious scene that I can’t possibly post.
His lawyer should not have put him on the stand, if he thought it was going to undermine his case. A defense attorney has to be aware of what his client is going to say.
bubba clinton......... never let a passed out babe go to waste
Bill Cosby?
Two “Bill’s” come to mind. Which one?
I’ve heard so much defending of BC, that it almost comes as a surprise to see a man on trial for raping a passed out woman.
Oh those wacky Amish.
Hint, his last name begins with the letter “C” and contains two syllables.
McNeal is white
Cosby is the guy that likes them unconscious, or drugged into immobility.
Words fail me.
What took the jury two hours to decide this? Were they delaying to get a free lunch?
Read the article:
"Robert Shipman, who represented McNeal, said his client "killed himself on the witness stand." Shipman had told the court, with the jury present, that he was not going to call any more witnesses. At that point, McNeal stood up and demanded to exercise his constitutional right to testify, his lawyer said."
Just damn. And in Huntsville. Probably an immigrant. Huntsville is very close to the Tennessee border, and well, you know how those Tennesseans are...
Yeah, that's what I look for in a woman - passed out in a pool of vomit. Gets me hot every time.
Maybe he did it casually, not violently.
Interviewer: Stig, I've been told Dinsdale Piranha nailed your head to the floor.
Stig: No, no. Never, never. He was a smashing bloke. He used to give his mother flowers and that. He was like a brother to me.
Interviewer: But the police have film of Dinsdale actually nailing your head to the floor.
Stig: Oh yeah, well - he did that, yeah.
some brotherly love huh.
bang, oh ‘scuse me
