"If you don't want to get shot, tased, pepper-sprayed, struck with a baton or thrown to the ground," warns Officer Sunil Dutta of the Los Angeles Police Department, "just do what I tell you."
The thing is, Officer Dutta (pictured) is also an Adjunct Professor of Homeland Security and Criminal Justice at Colorado Technical University. And he uttered those words not in the heat of the moment, but in an opinion piece in the Washington Post responding to widespread criticism of police attitudes and tactics currently on display in Ferguson, Missouri, but increasingly common nationwide.
Dutta continues:
Don't argue with me, don't call me names, don't tell me that I can't stop you, don't say I'm a racist pig, don't threaten that you'll sue me and take away my badge. Don't scream at me that you pay my salary, and don't even think of aggressively walking towards me. Most field stops are complete in minutes. How difficult is it to cooperate for that long?
Dutta actually comes off as a reasonable law enforcement officer...He endorses the use of body cameras and dashcams to record interactions between police and the public. He counsels, "you don't have to submit to an illegal stop or search. You can refuse consent to search your car or home if there's no warrant."
And yet he demands unresisting submission to police without argument or even legal protest. Just how do you "refuse consent to search your car or home" without running afoul of the no-nos Dutta warns may get you "shot, tased, pepper-sprayed, struck with a baton or thrown to the ground"?
Remember, this is a thoughtful police officer, with a PhD., who teaches criminal justice.

And many cops are being taught to look for a CONFRONTATION with the peasant they have accosted...
Well, actually:
He has erected a multitude of New Offices, and sent hither swarms of Officers to harass our people, and eat out their substance.
We got a Swarms infestation, and it's political, in that we're paying taxes to support the Swarms.
Well, one could argue that the penalty was inappropriate and/or excessive but she *was* speeding.IIRC she was doing something like 75 in a 65.
Refusing to obey when I am within my rights is a cause I can support.
Refusing to obey a crimanal thug just because they have a badge is a cause worth dying, or killing for.
While it is often synonymous with a fine, it differs in that a fine is a fixed sum prescribed by statute and was often voluntary, while an amercement is arbitrary.
=========================
The reason I maintain that it's "arbitrary" is because usually the peasant is not the only one "violating the law" in instances like yours.
This "conclusion" is where this "supercop" and I part company.
First of all, NO people in all sorts of jobs should ever be expected to tolerate "nasty names and a little argument," In fact, most local "public employees" are very good at not tolerating a "smidgen" of that, rightly so.
Secondly, with the authority that cops are assigned, there is an obligation, too, not to overreach.
As the article at the link asserts, how can you comply with an aggressive "ask no questions" cop? There is nothing disrespectful or aggressive with, for example, "what did I do" or "why have you stopped me?"
Personally, I have had nothing but good experience the few times I have been stopped by an LEO, even when things were marginal, so I have no knee-jerk reaction to the process. Being polite and non-combative certainly helps.
As for searching my car, I am totally unworried about it but, on principle, I would ask for a warrant.
“First of all, NO people in all sorts of jobs should ever be expected to tolerate “nasty names and a little argument,” In fact, most local “public employees” are very good at not tolerating a “smidgen” of that, rightly so.”
A cop is usually not pulling over your average public employee.
“And yet he demands unresisting submission to police without argument or even legal protest.”
Why did the reason.com author choose to misrepresent the ‘cops’ words?
“First of all, NO people in all sorts of jobs should ever be expected to tolerate “nasty names and a little argument,” In fact, most local “public employees” are very good at not tolerating a “smidgen” of that, rightly so.”
I agree with you there, but the officers are verbally abused sometimes. But if they can’t control themselves to not retaliate with physical violence, then maybe they should quit.
I agree. Some, as in a small minority. Not all, not most, just a small minority. To those, you also just comply nicely and things will pass.
In a majority of situations things will be fine. Also, when people place themselves in bad situations, it isn’t the Cops fault when crap hits the fan.
Better call Saul.
Once you refuse a search and a cop still searches a good criminal defense attorney can have any evidence thrown out of court. If there was any.
Up the thread a bit is good general advice though: cooperate when you need to when there's a problem, then get the lawyer.
Too bad the dogs don’t have that option.
then you will likely sit there for however long it takes the police to obtain a proper search warrant from the local judge, or your car may be towed away and impounded until the warrant is either approved or rejected. If rejected, then you will be free to pick up your car after paying for the towing expenses.........
They got ya no matter what you say.........
Romans 13: 1-7 (NRSVCE):
“13 Let every person be subject to the governing authorities; for there is no authority except from God, and those authorities that exist have been instituted by God. 2 Therefore whoever resists authority resists what God has appointed, and those who resist will incur judgment. 3 For rulers are not a terror to good conduct, but to bad. Do you wish to have no fear of the authority? Then do what is good, and you will receive its approval; 4 for it is Gods servant for your good. But if you do what is wrong, you should be afraid, for the authority[a] does not bear the sword in vain! It is the servant of God to execute wrath on the wrongdoer. 5 Therefore one must be subject, not only because of wrath but also because of conscience. 6 For the same reason you also pay taxes, for the authorities are Gods servants, busy with this very thing. 7 Pay to all what is due themtaxes to whom taxes are due, revenue to whom revenue is due, respect to whom respect is due, honor to whom honor is due.”
Dear Dr. Officer Dutta:
Since you are Indian by birth, and not native to America, please allow me to define “Asshat” for you...
Asshat: Noun (N. American slang), one who has their head up their own ass, thus wearing their own ass for a hat. Also, a stupid person.
YOU (police officers) work for US...In America, the people rule...We are citizens, not subjects...This concept is routinely ignored these days by individuals sworn to uphold it in their oath of office, but there are still many of us who refuse to let it go, and would resort to force in response to keep it...
Read The Declaration of Independence, The Constitution, and The Bill of Rights, as well as The Federalist and Anti-Federalist Papers if your attention span will take you that far...
If you don’t want a target on your back, don’t paint one there...Asshat!
Most rapes are over in a few minutes, too. I recommend, Dutta, your wife or daughter undergo that experience for a few minutes. You might change your tune about the violation of anyone's rights after that....
” Dont complain when a planned
communist riot results in an innocent
(useful idiot) bystander like you gets his
skull cracked like happened to stupid
college kids in Chicago 68.”
Don’t complain when people go Dorner on cops then. LE aren’t Olympian gods, even though they have the ego of one.
” I tell you some people here are just plain
nuts! Why isnt obeying a police officer
fine in almost all cases? They are simply
doing their jobs. And the jobs we expect
them to do, safely and securely.”
I also expect them to do it with my dignity in mind. I have no reason to put up with bad attitudes by power tripping apes. I have no reason to put up with cops excusing the Dorner hunt shootings. I have no reason to put up with wii shootings.
Cops don’t operate in a vacuum. We expect high standards for behavior. And we expect the right to stand up to the constant poor behavior. If cops don’t like that, TOUGH!
If more and more people hate cops, maybe there is a reason. I hate street gangs too. Does that make me a ‘hater’?
“How would any of you haters out there
like to do that job knowing any stop you
make could easily end your life these
days!”
Nonsense excuse for crummy behavior and cowardice. LE isn’t even in the to ten.
