An Article V convention seems to be the only way to stop Ubama. If we don't stop him soon...

If we pass a “Balanced Budget” amendment no doubt it would be ineffective because of the accounting tricks that can be played.

Not if passed in conjunction with an actual physical store of [non-common] money: i.e. that is, tied to the amount of gold, silver, or other physical commodity.

Impeachment is the remedy. What you are bloviating about is not a remedy at all. Obama would just ignore any changes to the Constitution like he ignores the Constitution itself.

As explained over and over to you guys your entire premise is flawed and assumes that just conservative minded changes to the Constitution can be made. Real tiring wasting time on this nonsense.

Article V needs to be tried, even if it fails, before a cold/hot CWII starts if only for the reason of exhausting all alternatives so the states have the high moral ground this around....

That's where we're at. Materially, we could pull out of this nosedive peacefully via Article V. But realistically ...

... we are living in very scary times, on the edge of a powder keg. A tyrannical minority, leftism, has seized government. The majority hates it. But the minority left has usurped power across Federal and state levels, from education to the EPA. Minority leftists have to deceive the majority even within the Republican party (Mississippi, Romney).

At some point, brute force will come into play as a majority rises up against the leftist minority that wants to be master.

...expect the left to try to hijack the process, and be ready to counter it.

Amen, Bro FReeper.

I'm inclined to think that the more realistic appraisal is that it's too late. I hope I am wrong. I hope and believe that there's a good chance a seeming miracle could happen, where we could salvage this peacefully for a return to limited government and respect for human dignity and freedom in America. God works in mysterious ways.

A plug for your books -- Even a year or so later, I am still finding a lot to digest intellectually and emotionally having read your [haunting] trilogy around Enemies Foreign and Domestic (or most of it!), and HIGHLY RECOMMEND THEM to all FReepers, they are excellently well written, on equal footing with Clancy, very well done. So good that I find myself frequently replaying scenes from the book in my mind. Very powerful writing.

In fact, Matt's books are are so good, so real, so right on the mark, that I, rabbit-hearted, have put the trilogy on pause and not finished because I'm chicken! {^) Too close to home, Matt!

I fear for my country, my loved ones, and myself; but the Lord is with me, and I trust in Him.

"Make new laws to stop a lawless government. That’s what we’re putting out hope in?"

Do you have an alternative?

"Congress runs the whole show for constitutional conventions”

Really? How does that work? You never explained that.

The Congress, whenever two thirds of both houses shall deem it necessary, shall propose amendments to this Constitution, or, on the application of the legislatures of two thirds of the several states, shall call a convention for proposing amendments, which, in either case, shall be valid to all intents and purposes, as part of this Constitution, when ratified by the legislatures of three fourths of the several states, or by conventions in three fourths thereof, as the one or the other mode of ratification may be proposed by the Congress;

Okay, that’s what it says. This is how it will be interpreted by the Left and the MSM. Note added all caps.

THE CONGRESS, whenever two thirds of both houses shall deem it necessary, shall propose amendments to this Constitution, or, on the application of the legislatures of two thirds of the several states, THE CONGRESS shall call a convention for proposing amendments, which, in either case, shall be valid to all intents and purposes, as part of this Constitution, when ratified by the legislatures of three fourths of the several states, or by conventions in three fourths thereof, as the one or the other mode of ratification may be proposed BY THE CONGRESS;

See how many ways there are for bad actors to weazle this? Mark Levin is a very smart man, and on a level legal playing field he will win every time. But I think his approach is going into a ring with the Marquis de Queensbury rule book, and getting sapped by the ref climbing into the ring.

If we open up this Article V can of worms, understand, it can easily get away from us. Not that I would oppose it. If we are going to fight for the Constitution, I’ll fight on that side.

But know that this might not stay inside of Mark Levin’s legal boundaries.

"I wish someone would offer something?"

That's what Article V is. An alternative. An alternative to violence. Is that worthwhile?

We sure do live in momentous days. This is the last serious thing I've written, and I wish folks would read it.

If anything else I've written leads lots of people to read this, I'm gratified.

So, because Congress is mentioned three times in Article V, that gives them control over the convention? I still don't see it. What would be the process by which Congress could control a convention of STATES?

I would also add:

That Governmental Employees, aka Civil Servants, shall not exceed 1/10 or one percent of the total population of Natural Born Citizens of the United States and be drawn exclusively from that group of the Population of the Citizenry of the United States.

Obama would just ignore any changes to the Constitution like he ignores the Constitution itself.

That's why structural amendments are very important. They must be amendments that cannot be ignored.

For instance, how can one ignore a repeal of the 17th amendment? If a state chooses to send a new Senator to Congress, how can the current Senator ignore that? Will he refuse to vacate his office?

If states choose to send a new class to Congress that drastically changes the balance of power in the Senate, can Obama ignore that? If the new Senate overrides a veto, would Obama just ignore that?

FRiends, this thread is the start of the most needed discussion on this site, that is the beginning of programmatic thought combined with a conservative constitutional POV.

This is where, IMNVHO is where the Tea Party should be going. In anything having to do with humans, one can never boil out emotions and personalities, but that is precisely what is driving the election process today due to the general dumbness of the media-directed, politically unsophisticated, and an increasingly illiterate, government-dependent electorate.

I want and yet fear a Constitutional convention. How can we exclude the left, much more well-organized and with MSM support, exponentially better and effective at PR than our herd of conservative cats? E.G., Could we wind up with a Gay Marriage Amendment?

Perhaps those states with Republican Governors and legislatures could begin by being more assertive of their rights, if the Tea Party (no one has ever told me exactly what that is) were to start campaigning at a level lower than Senator and Congressman, where the big RNC money makes them very vulnerable.

“...as the one or the other mode of ratification may be proposed BY THE CONGRESS;”

Congress gets to decide.

At least, that’s what Congress and the MSM agree, if Rats control congress. Of if any other chicanery can be imagined, that will be fully backed up and supported as reasonable by the MSM.

It’s a very badly written paragraph, almost a land mine planted in our Constitution with the potential to save it or to blow it up. It can be read and interpreted many ways, but by the word count and phrase count, on syntactic points, Congress will have the strongest claim to be in charge, especially if it benefits the Left, and the MSM nods agreement.

Forget about the Queensbury Rules, and expect to get back stabbed or poisoned, probably the worst damage done by bad actors in your own party.

The states need to start getting their power back.

States' Rights? The CSA made that a non-starter for all time by combining their right to secede from the Union with their wish to keep slaves. Let's call it "Sovereign Power" or something like that.

We need a brave Republican Governor and an equally brave Republican State Government ... and I sadly cannot think of one!
