California Supreme Court Rules 7-0 People Cannot be Detained for Trying to Evade Police Officers

The California Supreme Court declared that law enforcement officers cannot detain individuals because they attempt to avoid police contact. This unanimous decision has stirred a significant response from police unions, who argue that it will hamper their ability to maintain public safety effectively.

The court, in a 7-0 decision, stated that actions such as appearing to conceal oneself or acting nervously do not alone provide a sufficient basis for officers to detain individuals.

This was elaborated in an opinion by Justice Carol Corrigan, emphasizing that while such behaviors could be considered within a broader context, they do not meet the threshold of “reasonable suspicion of criminal activity” necessary to legally detain someone.

Lol, yep... Reminds me of when they legalized Medical Marijuana in Ca, they continued to bust folks even with legal medical cards for another year. Really messed up the court system. they did more damage to the court system than they did good for the public like they thought they were.

And unfortunately you might have that one wrong. If they look suspicious or are black many here will claim they absolutely should be stopped and frisked immediately.

I agree with the decision. No one wants to interact with the police. Even if they are just going their merry way and committing no crimes. Police will use the excuse of “He looked nervous” or “he had his hands in his pockets” to stop and question someone.

If you see an officer and turn off to avoid the interaction, it doesn’t mean you are guilty of a crime. Maybe you just don’t want to take the chance that it is a cop with an attitude looking for a reason to make an arrest. And if they want a reason, they will find it.

Police are supposed to be aware of a particular crime and then look for the perpetrator. Not look at a guy and think “He might be a criminal, I better stop him and ask if he is walking down this street for legal purposes”.

Read the article from the LA Times, and yes it does. The whole premise to the article is based upon the Racial Justice Act, a 2020 California law that prohibits discrimination in the state’s criminal justice system based on a defendant’s race, ethnicity or national origin.

So what they are saying is that if a person is white, he can be arrested for trying to evade police scrutiny in a high crime area even if there is a crime that the ID matches him. And the only reason a black man is being ignored, is not because he is trying to get away with something, but that he is black. That’s not a bad ruling, it’s rediculous.

How about circumstances matter! Consider a serial shooter at the mall or some other public place. Police arrive and notice a person hiding. You're telling me the police can't stop, detain and frisk that person? Circumstances matter!

I expect only one thing from the police. It’s what I’d expect from a plumber or a dentist or a bus driver. It’s professional behavior.

Unfortunately more and more police are acting unprofessionally. They bully, and they escalate. I get that their job is difficult!

But good people should not have to fear the police. But that’s what’s happening more and more these days. Good people are fearing the police. And they are being mistreated by the police. This is obviously not the right direction to be going in.

...I agree, the cops usually make matters worse in most situations. I would prefer to avoid them, both of us mind our own business and be on our way.

They've always acted that way. Often, they've escalated. Everyone is paying the price for it.
