Rush a 'Little Frustrated' by Drug Allegations

Political commentator Rush Limbaugh (search) returned to his popular radio program Friday and said he was "frustrated" about allegations that he was involved in the sale and use of illegal drugs.

Limbaugh was back on the air one day after his name surfaced as the possible target of a criminal probe into the sale and use of illegal drugs in south Florida.

On the national program, which is carried by about 650 stations across the country, Limbaugh spoke briefly about the allegations of his drug use but avoided going into specifics. He said he was "a little frustrated" that he had not "gotten to the bottom" of what was happening.

"The story in Florida really is an emerging situation ... I don't really know the full scope of what I'm dealing with," he said. Limbaugh said he'd been humbled by all the supportive e-mails he'd received from fans, estimating he'd received about 25,000.

As for all the media stories that have emerged about the drug investigation, Limbaugh said that he was "tempted" to respond to them but "I'm not going to go there."

But he vowed to discuss the case in detail in the future.

"Rest assured, I will discuss this with you and tell you how it is ... maybe more than you really want to know about this," he said.

There is a neat little trick in the law where evidence admitted to prove one thing can then be used to prove something else -- even if, originally, the evidence would not be allowed for that purpose. Does that make any sense to you?

No, this doesn't make a lot of sense. Why don't you illustrate your point with a real world example of an innocent man getting in trouble for denying false charges?

Wrong. Innocent or guilty, a lawyer will tell you to say nothing one way or the other to anyone. See post #117.

All this info can be found in the Federal Rules of Evidence. As you'll see, Rush MUST NOT SAY A WORD about anything substantive that occured, EVEN IF IT IS EXCULPATORY.

In certain cases it makes sense but if you have never bought illegal narcotics you just say that.

That is EXACTLY right. I would tell and have told clients to make no comments WHATSOEVER. No matter what the case, words can and will be twisted.

It does not take much to make a winnable case a looser by trying it in the media.

I hope Roy Black demands all phone records of the filing prosecutor's office.

It is not the Enquirer anymore. (Thought they are more accurate than the New York Times on average) The sherrifs department has confirmed this to the mainstream press.

The sheriff's department has confirmed that Rush is a drug addict? Uh-no. You specifically said he is not innocent, and that he is a drug addict. The sheriff's department has not confirmed either one of those two statements. They may have confirmed that they are investigating something (some news sources say Rush specifically, some say not), but that's all we know at this point.

Thanks for the advice! Tell me, where did you get your law degree? I graduated law review/ with honors from a top tier law school in 1988.

Now, the first thing one might well say about these allegations, after one has had a chance to sit down, go over the facts, and strategize with your lawyer, is "I am completely innocent of the publicly made allegations, I don't use illegally obtained drugs, nor do I obtain drugs illegally".

Of course, since Rush was in Philadelphia, and his attorney was doing a talk show gig last night, we know the sit down part hasn't happened yet. It will almost certainly happen this weekend. And you may very well see Rush saying this very thing on Monday.

FWIW, and this is pure speculation, my take on this is that Rush very well might have obtained a few pills from his housekeeper prior to his ear surgery, without realizing /really thinking about the fact that this was illegal.

If that were the case, he couldn't exactly say what you want him to say, could he? But his conduct might well be understandable in light of his situation.

If Rush is on drugs, he's sure not fitting my impression of what somebody on drugs can function like. I'm not aware of him ever having been spaced out, zonked out, slurred, etc. Has anybody here ever known him to show signs of drug use? Not me.

How many junkies do you actually know? I've known many over the years, and most of them have functioned quite normally for years until their addiction catches up with them. The typical response from family, friends, and peers when they finally discover the truth is "I had no idea" or "looking back, I should have known there was a problem." This is particularly true when prescription painkillers are the drug of choice because in many cases the person takes the drugs not so much to get high, but to avoid the pain of withdrawl, which can be quite severe.

there is a news story on the radio that the quality of the maid's tapes are poor. There is another story saying that the tapes are of her OWN drug deals and Rush is not present.

I'm a little frustrated by his refusal to simply say, "I did not illegally acquire prescription painkillers."

Who is going to go on national radio and admit anything that might be used later to hang himself. If he got hooked on a pain killer, so what. It is not good but it certainly not without precedent.
