This has to do with a First Amendment Right found in the US Bill of Rights. From what it says, it appears that the Democratic Party Secretary of State is skirting the issue and not giving proper accommadations to Tom McClintock's First Amendment Rights, guaranteed by the Bill of Rights.

What are you talking about? What first ammendment rights? No one is abridging his freedom of speech. You seem to have fallen for the liberal belief that the first ammendment guarantees a right to be heard which it does not.

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances.

I've fallen for nothing. Every individual candidate for public office, has an equal right to have their agenda printed in a recall election pamphlet, along with other candidates. No secretary of state, has the power to deny any candidate equal treatment under law. That is an infringement of a person's right to free speech, contained in the BoR`s.
