Thanks again. It's not much (yet), but it's something. Unfortunately for 187, it's confirming what I suspected. I'll reserve judgment to see if McClintock will provide some "beef," such as a case in which a state governor reopened a case settled/buried by a prior governor several years earlier.

It's fairly easy to get this back into court.
You're probably right that they cannot reopen the appeal directly.
However, if Tom orders 187 enforced, someone like MALDEF or the ACLU will sue to enforce the injunction issued in the last case against 187.
And then, suddenly, there's a new case where the legality of the injunction can be argued.
