Thanks for that interesting tidbit. Let's say that Dewhurst declares the Senate seats vacant (if he's the correct person to do so) and the Dims sue for their seats back.... would the courts decide who's correct and would it go to the Supremes again? And in this case they probably would make a ruling... right??
Also, do you know if the Sergeant at Arms can arrest the fleeing legislatures if they are on the verge of departing... let's say getting on a plane or bus to leave the state? I just can't imagine that our Republicans were not unto their shenanigans after the House departure.
Actually, at least two of the departing State Senators live in the same condo units as I. I saw them here (shortly before they departed) gathered until the wee hours of the morning strategizing... and wondered what they were up to. Almost called Dewhurst's office, but then, I thought they were talking about strategy on the floor and not their departure.

These are good people who are working hard for the state,How can running away to prevent due process POSSIBLY be "working hard"??? If I tried that, I would be unemployed in a heart-beat! Not only that, but they are costing us, as tax-payers, a huge amount of cash because they refuse to DO their jobs and make it necessary for the governor to call special sessions......
Typical liberal dummycraps; double-standards apply (Republicans never ran away when dummycraps redistricted to THEIR benefit!), and Texans are forced to pay their bill - since dummycraps are all about tax and spend, they do not care.
"Good People"? The term that come to MY mind is "pondscum"!
Ah, I feel SO much better, having vented.....

It could backfire. If the Democrats refuse to go back and watch most of their fortune trickle by it would be an impressive and defiant stand. Americans still respect sacrifice on the part of ideals. Lucky for us they're a pack of conniving, money-hungry socialists.
Actually I think this will point out how the Democratic Party is the party of the Rich and not the working man anymore. My hubby already had a discussion after the last elections here in Texas about how rich the Democratic Governer candidate was. The guy he was talking to came back with "well, he can pay off our debt if he is elected." Hubby replied, "nothing stopping him from doing it now." The Demos are no longer the party of the "working class" and this will show it even more.

I am unsure who the "returning officer of the district" is and no one seems to be able to tell me. It could be the state rep, or the county party chair, or some other elected official.
It seems that the state constitution provides that the "returning officer of the district" may be able to declare the seats vacant and schedule a special election to fill the seats. The Dems will have to do something, they just can't sit and allow an election to take place that might replace them.
I do not know if the Sargeant at Arms can arrest a legislator without a warrant.

Lein holders don't register automobiles, truck, boats or PLANES with the registering authorities. The FAA being the 'registering authority' has the bank as the owner of the plane (or planes) in question.
