Another problem is that they are confirming district judges, not appeals judges. Therefore, the crisis is getting even worse as activity at the district level is on the increase but there are still fewer appellate judges.

I fully understand the fact that Frist's hands are tied, it is all the Dems fault. Plus there are some squeemish rino senators too. The goal for conservatives should be to force high profile votes on nominees, and make Kerry defend the obstruction. Than use that in the election.
You are right, the Dems say they are confirming so many, but that is mainly to the district courts, not the appeals.
