The state Republican Party was quick to point out that the [2/3rd’s] rule has been abandoned on occasion – such as when the Senate took up a state senatorial redistricting plan in 1992.

So abandon it NOW, you wimps!!!

They will. There are two different things going on here. The 2/3 rule referred to above is required to move a bill to to the floor for a vote outside of the order that the bills were submitted. Normally, in a regular session, there is a "blocker bill" introduced before any others, thus requiring a 2/3 vote to bring any of the others to the floor. Since in this second special session there will be no other business (the Governor gets to set the topics allowed for a special session), a blocker bill will not be in order and so the 2/3 rule won't apply. That's what the Dems are whining about.

The second factor is the need for a quorum to conduct any Senate business, will the flown 11, there is no quorum and the proivsion requiring one is not a mere legislative rule, or even a law, but rather a state constitutional provisiion. And other than sending a posse to NM, which wouldn't be a bad idea, but is out of Texas jurisdiction, absent "hot pursuit".
