Kennedy wrote the opinion.
He explicitly said that Bowers was "wrongly decided." Due process means people have a right to the privacy of their bedrooms.
I didn't get it all, but apparently this overturns ALL sodomy laws.

That'd be my guess, too.

Wow. The bedroom is now a sactuary?
I think may be next to go, followed by statutory rape, incest, and then nationwide recognition of gay marriage.
SCOTUS just defined sodomy as normal sexual behavior between adults. There is no reason, then to not legally recognize marriage between men.

I hope we get those two retirements and they are liberals or one liberal and O'Connor.
I am disappointed, but I expected this.
So quite frankly, I am having a hard time getting mad about it.
It isn't a vital issue, so I am going to reserve anger for other things even though I am not pleased with this.

Due process means people have a right to the privacy of their bedrooms That's not what due process means at all. It means there must be a pre-defined process for determining guilt or innocence where the accussed has the right to confront his/her accussers and present her/his side of the case. It says nothing about what may or may not be criminalised. Basically it says that justice cannot be arbitrary.
I actually think they used the "priveleges and immunites" portion of the 14 amendment to apply the 4th amendment to the states. I don't know as that is a proper reading of the 4th amendment though, since the 4th only protects "privacy" against unreasonable searches and siezures", not in general.
Now if they will just use the same 14th amendment provision to apply the second amendment, which is pretty absolute, to the state governments. But I won't be holding my breath waiting for them to do so.
