i think you hit on something important here. "compelling government interest" seems to mean some phony excuse they use to override the constitution when that document says something that is inconvenient.

Thomas said that there couldn't be a compelling government interest to discriminate in law school admissions because there is no compelling government interest in having a government-run law school in the first place.
