Spousal privilege stops at divorce. A spouse can be COMPELED to testify. No immunity applies. Immunity is asserted by the spouse who would like to not testify not the defendent. Ask any defense lawyer. There would never be any grounds in divorse cases if the defendent was protected by spousal privilege.
