As the findlaw article points out one of the more interesting parts of this case is the fact that Modesto PD allowed the Rochas to get away with a televised burglary and grand theft of Scott's property.

The fact that they have plenty of evidence and the Rochas even admit to the crime, but have not been charged indicated that MPD is strongly biased against Scott.

Whether we like him or not, it was his property, and before it was disturbed he did have the right to an independent examination of the house & its contents.

How does the court balance taking away his best chance to come up with evidence of his innocence? Clearly the MPD was prejudiced against him & might not have even bothered to collect anything exculpatory.

Gettiing a fair trial in this circumstance could be very hard to prove.

curly dave......how would the cops know that it was not the business of the Rochas to be there taking their dead dtrs stuff....afterall, it was done in broad daylight..hardly a criminal's method....

it is a civil case imo....

fair trial?....you kidding?.......they had bumper stickers on their cars down in San Diego about westerfield....

and how do you think SLC is going to treat the two Smart (not so smart) kidnappers???:

its tough out there but we can't move every big trial ......

It was reported that Scotts own mother admitted to going into the house & cleaning it up with her husband, previous to the Rochas going in, so the site was disturbed or tainted by them already!

the taking of items in Scott and Laci Peterson's home that Friday, was declared a civil matter, not criminal, and MPD was on stand-by... They (Rochas) did have keys until Jackie and Lee Peterson changed them all preventing the Rochas from retrieving Laci's items.

In the views of MPD, this was a civil matter, not criminal. ;o)

But Jackie Peterson holds a power of attorney for Scott. Presuming that Scott is the property's owner, that gives Jackie the right to give someone permission to enter the property.

And Jackie did just that. I heard it myself, and so did several others here. On national TV, b/f the day the Rochas entered the house, Jackie said "Sharon can go in there anytime she wants."

And the things they took? Well, Scott may have become the sole owner of the house on Laci's death (through having held it with Laci in joint tenancy w/ right of survivorship), but that does not mean that Scott necessarily was the owner of everything in the house. Some of that property might well have descended to the Rochas. The Tiffany lamps given as GIFTS to Laci by her grandmother, for example. Oh, btw, guess where THOSE were? They were at Kirk McAllister's office. And as the Rochas were committing this "crime", Kirk McAllister had those lamps brought over from his office and turned over to the Rochas very quickly. Guess Kirk McAllister, a California attorney, thinks the Rochas have a right to some of the property, too.
