Hey, chiefy, if you could read with understanding, you'd know that I'm not referring to differences in ranks, but in duty positions. Rather like the fact that for a long time in the Army warrants had no command authority and could not administer USMJ. I now personally know of a situation where the most senior officer of a unit is not the commander.
