If Scott gets out on bail, and gets hold of a death certificate, he could get the $, couldn't he? Devil_Anse said on another thread that in Ca., insurance has to pay uness benefeciary is convicted of murder.
If true, would the family be wise to file a wrongful death suit asap? Would be sick to think he could use that $ for his defense.

The insurance company can raise their own defenses and probably hold payment on the claim until after a trial. They don't want to pay on this claim, you can bet that and insurance companies have a lot of power when it comes to paying on claims. There's a powerful insurance lobby for one thing.
And, there's the matter of actually reading the policy line by line. The policy dictates what happens in any situation.

Since I posted that, uvular, another poster has weighed in. Poster "An American Mother" has apparently been directly connected with insurance litigation of this kind. She said--and she sounded certain--that the insurance company could delay paying the claim WITHOUT FEAR OF BEING SUCCESSFULLY SUED, under these circumstances. That's really good news, as far as I'm concerned!
