Obviously you mean "Summary Execution", not Summary Courts-Martial"! It requires a General Courts-Martial for serious crimes!!

I witnessed one of these "events" in Vietnam in 1971. The miscreant who killed 3 Lt's with a grenade, was given a high-priced lawyer (ACLU & NAACP) and a civilian trial...and beat the rap. This after a confession and several witnesses.
