To: Lib Buster; Utah Girl
I don't know about Utah, but some states have a statute that allows a person to be found "guilty but insane". Should they ever be judged to be mentally fit, they are released from the "nut house" and go straight to the "big house".

Those states are in the minority, unfortunately. I hope more states adopt the "guilty but insane" laws.

I've pinged Utah Girl to see if she knows or knows someone who does know what kind of insanity laws Utah has.

Utah does have the guilty but insane plea. I have a friend who does forensic evaluations on people to determine their state of mind, and whether or not they can be charged criminally. Once they are judge sane, then they get to do time in prison for whatever offense they have committed. The law is pretty strict, and she can pick out someone who is trying to game the system pretty consistently. She says the ones that are hard to read are crystal meth abusers, but even then, it can take up to six months to get a proper read on them.
