Nope. If the neighbor would simply show some respect while exercizing their right to smoke, she could have her right to breathe clean air. The only person forcing anything here is the smoker - who insists on forcing everyone around to breathe their stinky air.
Again, I have friends who smoke (even a friend from FR- like, OMG!) and I don't have a problem with it, because they are considerate smokers and they don't have a chip on their shoulder about their "right to smoke".
How does a smoker force anyone to be around them?
The chip on our shoulder... if any, is the heavy weight of fanatic anti smokers.
Not to be combattive here but can you point out where this is in the Constitution ??
Also, I'd make one small recommendation to your friend in the condo. Buy a Honeywell HEPA filtration system for the air in her house (gets rid of smoke and a lot of other items). I have one and smoke indoors (rarely), you cannot tell that I'm a smoker from my home. If they can afford a 350K apartment, they can afford a 170 dollar filter for peace of mind.
