A declaration of war is not necessary for a state of war to exist. The United States *never* declared war against the Confederacy, yet we were at war.

Additionally, it is not necessary for a state of war to exist to pursue a charge of treason. Aaron Burr was charged and tried for treason, even though the United States was at peace -- throughout the time of the alleged treason, and throughout the trial.

Having settled that issue, who is going to get the rope?
