your argument is based on whether exoneration = innocence.

Hmm, at first I thought to write: "in the eyes of the law, exoneration does equal innocence." That's not necessarily true, you are right, but it does say that that person cannot be found guilty from the evidence presented. I suppose exoneration can exploit the law, but then so can capital punishment. Do we need to make a decision as to which is more abhorrent - a guilty man going free or an innocent one being put to death?

I think we have already decided that is best to err on letting a guilty man go free. Its just that I don't know enough about these cases to determine what "exoneration" means.
