Well ... I'm willing to give Frist the benefit of the doubt - instead of joining the group which says he backed down on his promise to make them filibuster.
The other reason is that after this supposed "backdown" from Frist, there was not a dem media conference laughing at the repubs for backing down; which is their usual style.

It would be unseemly for the RATs to be filibustering a judicial appointment when we go to war.
