Because from the fact that the Supreme Court has traditionally taken a relatively lenient view of federal actions presented as wartime needs, it follows that legislative bans being found justifiable during wartime in no way implies that they would be justifiable during peacetime.

It's a way of avoiding all of the decisions that have made on the issue.
