I have to say, you hear a lot of nutty stories like this, but this one really stands out. You are telling me that the childhood rhyme for picking something/someone even w/o any racist content, is actually grounds for a lawsuit because of its racist history???? The part that really gets me is that the judge is letting this continue.

It's scary, isn't it. And I'm pretty sure the racist version was a later regional variation -- not the original version. So if any random verse or saying is ever the subject of racist/sexist/you-name-it-ist knock-off at any point in its history, then according to the legal theory espoused by these whiners and their lawyer, it should forever be grounds for legal action if anyone uses the original version or any other non-__ist version.
The judge should have thrown this suit out instantly, and then launched a legal action against the plaintiffs and their lawyer for filing a frivolous lawsuit.
