Here's what Sen. Biden said: "If I had this evidence before a jury that was an unbiased jury, I could get a conviction." To get a criminal conviction, you need to prove guilt beyond a reasonable doubt. In foreign affairs, it's often necessary to operate with much less certainty than that. But Powell's speech may have met the proof beyond a reasonable doubt standard.
