Dear Editor,
Mayor Wesely and Chief Casady cast their net way too wide with their planned restrictions on gun ownership (Mayor, Chief Seek Gun Restrictions, January 31.)
Making life difficult for gunowners won't reduce crime, gentlemen. We tried the whole antigun shebang, here in Australia- banning semi-autos, gun registration, buybacks, the lot. And we have seen subsequent increases in violent crime, in certain states, of up to 40%.
Don't make the same mistake we did, Downunder. Target criminals, not responsible gunowners, if you really want to reduce crime.
Yours faithfully

Sorry that the post was not profesionally put up. But the major point of this story is that the fine Citizens of Lincoln Nebraska that have ever been convicted of any of the 19 Misdemeanors can never possess guns again! Police Cheif Tom Casady is largely responsible for this proposed legislation. Any thoughts or ideas would be helpful.

The only part that makes any sense is not leaving a handgun in a car for 24 hours, only a fool leaves his pistol in the car.
I always thought the people in Nebraska had their heads on striaght, My brother tells me, you have to get a permit to buy a pistol in the City of Lincoln. Things have really changed since I left 15 years ago.
That is a tough one, sounds like the city council is front loaded with gun grabbers. The only thing I can think of is fill the council chamber with folks that object, every time they meet, and every one there fill out a request to speak. Filibuster them until they change their minds.

I wonder if
these folks know about it. I found this info on their website.
Keep the week end of June 7 & 8 open.
That is the date of the 2003 Annual NE Shooting Sports Association's Annual meeting.
The location of this year's meeting is Lincoln, NE
I also found this here. I'm not certain if this is intended as a preemption law or not.
STATE CONSTITUTIONAL PROVISION |
"All persons. . . have certain . . . rights, among these are . . . the right to keep and bear arms for security or defense of self, family, home, and others, and for lawful common defense, hunting, recreational use, and all other lawful purposes, and such rights shall not be denied or infringed by the state or any subdivision thereof." (Article 1, Section 1). |

Am I on crack? did I really read the rep from the ACLU was threatening legal action?
But the language of the proposals could ignite legal challenges if written too broadly, said Tim Butz, executive director of the American Civil Liberties Union of Nebraska. Butz worried most about the inclusion of "obstructing government operations" among misdemeanors that could eliminate someone's right to bear arms. Political demonstrators, particularly at war times, are cited for such crimes, he said.
Seriously, if you can get a juggernaught like the ACLU on board for good instead of evil (or, more often, just plain silly), that'd be HUGE!

" Outlaw firearms possession for people convicted of any of 19 charges the mayor and chief selected as "serious, violent or potentially violent misdemeanors." "
Sounds like "infringdd" to me.

Outlaw firearms possession for those who are convicted of even
attempted 2.Carrying a concealed weapon, 4.unlawful posession of explosives, 5.use of explosives without a permit, 8. Furnishing Firearms, ammunition, or weapons to minors, 9.Resisting Arrest, 16.Violation of a protection order, or
any felony...
now let's discuss the easy openings for abuse set out here that will undoubted come up soon after passage:
2. CCW permits do not seem to be exempted
4. and 5. Fireworks, maybe even ammunition (reloading equipment?)
8. Christmas presents, taking your child hunting, Swiss Army knife,
9. "Resisting arrest" is entirely up to the arresting officer... and attempted resisting arrest must be fun to define... maybe struggling with tight handcuffs?
16. most divorces now feature protection orders... and many demand that the subject get rid of all their firearms. Refuse? Lose your right to own them, too.
19. any felony (or attempt) includes several volumes of laws that are not listed here, and the modern trend is to include an ever-increasing amount of laws under the felony umbrella, "to deter crime"...
and let us not forget how easy it is to amend this ordinance to include so many more reasons to deprive a citizen of their 2A rights.

This is the kind of law that can sail through if not enough people know about it. Any significant opposition is likely to doom it.
Call every gun store in the area. Better yet, make up some eye-catching posters and go around and ask if you can put them up in the gun stores. I've done that locally. Well, I've done a lot more than that but that's another story. If you can, get someone to go pamphlet any gun show or shooting event in the Lincoln area.
Contact Senator Tom Baker's office and ask his staff if there are any friends of gun rights or other organizations that you might contact.
GOA's last alert for Nebraska was in October 2001. I'll drop them a message. A lot of GOA members don't do much until GOA issues an alert. I suggest you drop them an email too. Or call them.
You could try the NRA as well. They're probably bigger than GOA.
You might even find some opposition among state law enforcement officers.
Try
Nebraska Second Amendment Watch. He hasn't updated recently but an issue like this might get Rick moving.
Also, try contacting
Nebraska Taxpayers For Freedom, Second Amendment Project.
You might try informing
Hunt And Fish Nebraska. It's largely an outfitter site but anything that makes it harder to hunt or adds any element of legal jeopardy to hunting in the state should be a concern to them.
Of the whole bunch I listed here, getting the gun stores riled and active and getting out a GOA email alert are the two most likely to result in letters, calls, email, letters to the editor, etc.

Prohibit people convicted of theft or a theft-related crimes twice over the last 10 years from selling or trading property to pawn brokers and dealers of secondhand jewelry. I've got no use for gun control, but you have to like that one.

Some of their proposals - like not leaving a gun in a vehicle overnight - make sense in an urban area.
Some of their selected offenses make sense, others are frivilous. The problem wth this stuff is always that the real criminals ignore these laws. The other problem is that if EVERY city in your state did something similar to this, you would have a miscellaneous mess of conflicting and equally arbitrary rules which will help only the parasite class (i.e. attorneys) earn more money.
If you're willing to face the peanlties involved in a murder, armed robbery, or drug trafficing, a minor gun violation law is small change. Consequently thse laws impact mainly law-abiding citizens and are part of a determined effort by the pacifist, anti-gun crowd to disarm the American public, just as they are diligently working to stop Bush from using military force to protect U.S. citizens and U.S. interests.
How are laws enacted there? Can the Mayor and Police Chief just issue edicts or does a Town Council have to approve it?
If the latter is the case, lobby the members of the town council while making it clear to both them AND the Mayor that you will actively support ANYONE who runs against them in the future over this issue. You might contact the NRA for political advice. Since some of this stuff makes some sense - sort of - you may want to lobby to have the bill approved in a manner so modified and so diluted that it has little or no impact on law-abiding citizens.
Most importantly, you should work on the state level there to have a state firearms pre-emption law. This in effect states that the State alone, not any local jurisdiction, has the the right to enact gun legislation. Then hopefully, rural and suburban elements in your state would be more likely to oppose repressive gun laws than the idiots in the cities who have to deal with populations which can neither control themselves, or accept control by others.
In many states, there is a web site which lists all legislative actitivties in that stae - new bill introductions, sponsors, bill status, bill content, state legislative committe members (they kill bills you don't like byb preventing their release to the general legislative body for a vote). MONITOR these sites REGULARLY.
It will help you identify your friends and foes. It wil let you know what special interest lobbies like the Trial Court Attorneys and Insurance lobbies, don't WANT you to know.
FINALLY, and MOST IMPORTANTLY, register with one of the major political parties and vote in their primaries (I would humbly suggest the Republicans - 99% of Democraps are anti-gun) and support pro-gun candidates. The REAL decisions in elections are made in the Primaries, NOT the general elections.
Keep your powder dry.

One talking point.... the 1st amendment says "Congress shall make no law prohibiting"... which meant that the federal Congress couldn't make laws but the States could about freedom of speech, religion etc.
But the 2nd amendment says..."shall not be infringed" meaning that no one... state, federal or local could infringe the right to bear arms.
Check your state constitution it probably has a "right to bear arms" law too since most states wrote it in their constitutions when they joined the Union.
Use both in your letters and to the mayor and council members.
Good luck in your fight, yes we must constantly fight to protect our freedoms.

"The 19 "potentially violent Misdemeanors" are: ... Carrying a concealed weapon"
So, a lawful gun owner lawfully carrying a gun openly, who happens to have his jacket cover the gun (a fashion faux-pax at worst) becomes unable to posses guns any more.

How does Nebraska define each of the misdemeanors? Post the statutes.

This is how the gun banners hope to stamp out the shooting culture in America, by criminalizing so many aspects of taking kids shooting that no one will risk teaching safe firearms practices and marksmanship to the next generation.
Thus is bred a nation of slaves, "Sheeple Nation."

I wonder if there's any
coincidence that there's a bill up in the legislature to provide for concealed carry in Nebraska (only about the fourth or fifth time).
The timing's just about right to make one suspect it.
