What won't work:
1. Laci committed suicide. (She sure hid her body well!)
2. Self-defense. (No one will believe it!)
What he may be charged with:
1. Manslaughter.
2. Premeditated Murder.
His defense argument:
The last time I saw my wife was at 9:30am on Christmas Eve. I was fishing and returned home later in the day. During that time I assume my wife was abducted either from the premises of our residence or outside the home by unknown perpetrators. The blood the police have found indicates to me that there must have been a struggle inside the home as my wife fought off her attacker(s).
I admit I was having a romantic affair with Ms. Frey which was wrong and I am heartily sorry for it, but I did not kill my wife. I am not guilty of the charges brought against me. I assume my wife is still alive and I am doing everything in my power to find her.
Or at least it may go like that.

Scott says he left home at 9:30 am and went to his office to do a few hours of work. He kept a 14-foot aluminum boat stored at his office and after working decided to hook it up and take a short fishing trip in the San Francisco BayHe seems to have been a very busy boy. Do a few hours of work then go fishing...

So he had a friend or family member "break in" and replace things that had been missing? Why would he want the murder weapon brought back in, though? What other things would he have to put back?

Yaelle,
How about a golf club?

I imagine Scott's struggling between two conflicting notions. On the one hand, you can bet that he just wants to get out of this spotlight he's in. I'm sure he's looking into selling the house, as people have said. (Totally separate from what people have said about his having maybe planned to sell the house BEFORE the disappearance!) I'm sure he doesn't want to hang around Modesto, where Laci's family is present. But he's got his business there, so he has to stick around some. (Wonder if those bigwigs from Tradecorp were discussing Scott's possibly relocating his franchise?)
On the other hand, there would be his attorney's advice. A poster claimed that evidence of flight to avoid prosecution is admissible in a criminal trial in CA. (If this case ever comes down to a criminal trial...) I checked it out and it appears to be correct. So if Scott were to leave Modesto or CA or the country for parts unknown, that might very well come back to haunt him in the form of "evidence of flight to avoid prosecution." So his attorney is probably advising against Scott's dropping TOO FAR out of sight.
Probably if Scott is telling his attorney, "I just can't stand all this public attention, I want to leave," maybe the attorney is trying to work it so that Scott drops from sight of the public, but officially keeps his whereabouts known to the authorities through the attorney. That might be the compromise they are looking for. In that case, WE would see Scott disappear from sight, but the police would be kept informed of where he was.
If I were the police, and that happened, I would be sorely tempted to leak his whereabouts to the press, just to keep some heat on him. Don't know if they'd do that, though.

The potential arrest will be for presumptive homicide. He will be taken into virtual custody and will be constructively handcuffed. There will then be a circus trial by media.
To: PLMerite
Silly! Don'tcha know they have to diddle someone famous to get in Playboy?
To: pbear8
Yeah--can you believe that? His timeline was already highly improbable, now they add this "worked for a few hours"? Worked for 3 hours, say, drove for a minimum of 3 hours there and back, that would give him a total of about 2 hours to launch the boat, fish, and bring the boat back to shore and hook it back up? It's getting ridiculous now!
To: Devil_Anse
I think that the circus is already under way. I thought that I read something about Laci's father going fishing on Christmas Eve. Have we determined who he murdered and where he hid that body?

I was thinking more along the lines of it being the original. Even the most dysfunctional of families you would THINK would say "okay, we are gonna let this brat ruin our businesses, our reputations, our health, etc., and is it really worth it if he's guilty?"
To: FreePaul
No offense, and I respect your opinion (which I don't really know yet!), but you're not telling me that Scott doesn't look highly suspicious at this point, are ya??
To: L84AD8
Whoa...now THERE'S a thought!
To: pbear8
Maybe they bought the replacement item from Wal-mart, and took the used item back to Wal-mart for a refund. As we know, Wal-mart is very agreeable about returns! (Which is one reason I shop there.)

The unofficial word out here in N. Kali, is that some frustrated cops in Modesto contacted Rita and told her that they were being blocked in presenting the evidence.
So like she did in the DC Sniper's case, she blew the lid off of this PC mess.
Since then, apparently Scott's lover has been singing like a bird, and others in the Modesto area are now rolling over on Scott.
Hopefully they are watching him like a hawk with a pack of blood hounds. He may just try a run for the border, either Canada or Mexico. If he gets there, the lefties in charge of law enforcement will imprison him for years in luxury because California has a death penalty.

Yes, golf club, that is a good thought on L84AD8's part!
Have any of Scott's golfing buddies noticed anything missing while he's been out on the links with them since Laci's disappearance? (Per AMW's info.)
To: Devil_Anse
Golf club as possible murder weapon...geez...next thing we know, we'll find out he was up in a tree pleasuring himself...
To: Grampa Dave
imprison him for years in luxury ...which I hope will give the authorities ample time to find the bodies and build an airtight case!
To: Devil_Anse
LOL...Yeah, asking OJ to find the killer..... ;o)

I saw AMW, but didn't hear that! my mind must have wandered..thanks!
