You are very correct that the insurance company is not going to pay anything to anybody without a death certificate. It doesn't matter WHY a claimant doesn't have a death certificate. If the claimant feels that he is entitled to a death certificate nothwithstanding the lack of a body or official determination of death, they can take it up with the courts. The insurer is not going to touch it.

I have not read the last 100 posts on this thread, so you may already know. Rita Cosby will be live in Modesto, and her show is on at 9:00 central tonight on Fox. People seem to trust her, and she always gets exclusive interviews (like with the Levy's for example) and breaking scoops.

Amen to everything you say from an old insurance defense lawyer. I did mostly arson cases, with only occasional dead folks, but the principle is the same. Those insurance investigators will hunt the perp down to the ends of the earth!

Not only do they not like to pay out twice or pay on a bad claim, but if an insurer gains a rep for settling claims every small-time bunco artist in their territory starts targeting them. We had a claimant with a terrible run of luck -- she had 12 houses burn in 8 years -- and the insurer spent almost double the face value of the relatively small mobile home structure-and-contents policy (IIRC it was a 10K policy) to take the case to a jury, rather than pay her to go away . . . a case of "encouraging the others." (She had actually been PAID on the FIRST 11 fires . . . no wonder she kept at it.)

Thanks for posting them side by side. Now I see that there really is not much of a resemblance. SP (on the right) appears to have dark brown eyes, and the other SP has blue eyes. :)
