Or perhaps taking even a more daring stance, and allowing the constitutional process work as it is supposed to work.

This issue is in the hands of the Judicial Branch. The Administrative branch now has to await the decision of the Court, and enforce their findings.

The constitutional thing for Bush right now is to be quiet.

The work needs to be done BEFORE the case gets to SCOTUS. We need to seat Pickering and the rest.

This IS the fight.
