The WH has GOT to stay out of it. This is for the judicial branch to decide---and just imagine if the SCOTUS does the right thing and decides AA is BS and outlaws it, thereby ending handouts for minorities. The race card will be played by the Democrats saying President Bush is a racist.
Besides the separation of powers, he needs to stay out of it for political reasons and let the justices do the right thing on their own. It's about time.

After Florida, one can only imagine what they will say about the Supreme Court if the White House submits a brief and the justices outlaws it.

This is for the judicial branch to decide.Why? Do you think other controversial issues, like abortion, should also be decided by the judicial branch? If so, why have elected officials at all? While I would be delighted if the Supreme Court decides to roll back racial preferences, it is outrageous that the Bush administration and Congress -- our elected representatives -- would consider punting on this important issue.
