The perp had managed to commit a string of robberies with it, and had been arrested and released from prison a year ago on criminal possession of a weapon charges for a real gun.

Doesn't matter. The point is that if a perp wants to do the same thing again, he can get a toy gun from elsewhere, or fashion a "gun" out of any number of raw materials from soap to balsa-wood. What are we going to do, ban those materials as well? Please.

No disagreement on the law. Its pointless to say the least. But the usual suspects here and the family are trying to make it out like the cop should have known it was a toy. They want to string the guy up for a justified shooting so I thought it was important to mention that this was by no means a supersoaker.
