Both sides of the story could well be true. If the Bug had been chased into an oncoming car, he would be dead and they would be investigating the driver. From Toomey's point of view, an alcohol numbed robber breaking into his home in the dark didn't respond to a cop's warning and took a lot of shots to go down. Without more info than Toomey mowing the lawn in uniform, or some more info on the Robinson dawgs, there isn't much else to be done than accept Toomey's version.

Don't know the law where this happened, but in North Carolina the Bug's actions wouldn't have constituted grounds for a private citizen to use lethal force. Right or wrong, it wouldn't have been a legal shoot.
