No, it isn't. There is nothing in the treaty preventing me from mining the Moon. It only prohibits the US from declaring it to be US territory. Please cite the relevant part of the treaty to back up your mistaken assertion.

You can't file a claim for any part of a celestial body anywhere. You can't own any part of a celestial body. You are out of business as far as celestial bodiies are concerned.

For example, if you bring back moon rocks to sell as trinkets, you will get no further than the three who ripped the moon rocks from NASA.
