I know about the Supreme Court decisions but I believe the PA debate came about specifically because of this nutjob and his crusade.
Compelling students to recite the Pledge was held to be a First Amendment violation in West Virginia State Board of Education v. Barnette, 319 U.S. 624, 642 (1943) (“[T]he action of the local authorities in compelling the flag salute and pledge transcends constitutional limitations on their power and invades the sphere of intellect and spirit which it is the purpose of the First Amendment to our Constitution to reserve from all official control.”). Barnette was decided before the 1954 Act added the words “under God” to the Pledge.I don't believe anybody, anywhere is being coerced to recite the Pledge by government. Government can schedule time for voluntary recitation of the Pledge, no problem there.
