Published in the Asbury Park Press 12/03/02 Fire alerts authorities to nearly 500 weapons By MICHAEL CLANCY STAFF WRITER FAIR HAVEN -- Three dump trucks removed an arsenal of live ammunition and almost 500 weapons -- all of them apparently held legally -- which police found in a home after the fire department responded to a chimney fire and the homeowner threatened the fire chief with a rifle, authorities said yesterday.

The seizure of his entire collection of firearms isn't? There has been no trial to determine wether or not an assault with a deadly weapon charge was justified.

Smokeless powder is combustible, but requires containment for the progressive burning that makes it an effective propellant. It will detonate only under very specific and unlikely circumstances. In a fire, uncontained rounds will pop off their bullets with little force and burn out a little spurt. Black powder is a whole different animal, it burns rapidly at the same rate whether contained or not. It's possible to have black powder fixed ammunition. They would explode like firecrackers in a fire but the velocity of the freed bullet still would be much less than from a barrel.

Rounds in barrels in a fire will cook-off, where the pressure will build up due to the containment of the chamber and rifling retarding the bullet travel. The round will fire at full velocity. Fortunately, many powerful long guns are stored muzzle up in racks or safes, and pistol rounds are significantly less energetic.

As I wrote in my reply #120 to you, I am not here to discuss the legal status of this man's firearms. I am arguing that the Fire Chief has the authority to order this man from his home, and that by doing so, he did not violate this man's property rights.

From where does that authority come from? It sure as hell isn't listed in any of the State Constutions I've read.

Is it a good idea to cooperate with them when they are trying to help you? Undoubtably. Is it a bad idea to point guns at people, authority figure or not? You bet.

However, it has not been established that they have the legal power to order you from your home. Neither has it been established, except from the liberal press account, that this guy was in fact intending to aim the gun he was picking up at the firefighter.

The jumping to conclusions on this thread have been staggering. It has become normal around here that any actions taken by people trying to protect their individual Rights, are automatically labeled as "extremists", "kooks", ect... Bots like Poo-bear just can't seem to admit that government agents make mistakes and are sometimes given more power than their legal mandate by legislators more intent on re-election than Constitutionality.

All this on a forum called "Free Republic".

Who'da thunk it.

Yeah, it is, and she knows her stuff. My kid spent plenty of time in advanced training, including a number of classes at the National Fire Academy in Emmittsburg, Maryland.

So your confusion is about the nature of legal privileges. Fair enough. Could you please direct me to the relevant section of the US Constitution that establishes the privilege of, say, self-defense?

You can't. Does that allow me to argue that self-defense is unconstitutional?

I would imagine he forgot to say please, in the heat (no pun intended) of the moment. I wonder if that's cause for the homeowner to pick up a gun?

Don't care about lethal intent that is provable in a sterile courtroom, if I had been one of the fire fighters and someone in an obvious verbal dispute with one of my fellow firefighters picked up a weapon, I'd bury my fire-ax in his chest first, then check if the gun was loaded.......

We'll have to watch the courtroom drama play out over the next several months to see what is presented as fact but my point is that before fellow gun owners jump to this guy's defense, this is not a simple confiscation story. This is a confrontation that lead to a confiscation.....And the confrontation appears on the surface to be quite serious.

I guess you'd want a fire at your neighbor's house to spread to yours just because your neighbor told the fire department to get lost.

He did NOT tell them to get lost. He simply wanted to stay in the house while they put the fire out. This would have endangered no one, and the last line in the article gives it away. It probably took them about 2 minutes to put the fire out.
