Actually it's fairly simple.

The 17th(?) ammendment just called for direct election of senators by the people. Within that broad stricture, the procedures are left up to the state.

The U.S. bought LA from France (as part of the "LA Purchase"). French law was established prior to the purchase (Napoleonic Code?) They kept what they had rather than change their system.

Yes, the Napoleonic code is what we use. Merged with English Commonlaw it's not that bad minus the inheritance issues.
