S 61.009. Instructing Voter on Casting Ballot

On the request of a voter, an election officer shall instruct the voter on the proper procedure for casting a ballot.

Acts 1985, 69th Leg., ch. 211, S 1, eff. Jan. 1, 1986.

As long as the Clerk wasn't actually marking the ballot for the voter, it appears that they were following the law. The laws that you were referring to earlier regarding assisting the voter refer specifically to the voter actually needing someone to mark their ballot for them. Sorry, but it looks like the Judge - and the lawyer - were right. That is, unless you actually saw the Clerk marking the ballot for the voter?
