I notice that you still won't tell me what the difference between a former democrat and Mondale is. Nor the difference between Lott and Daschle.
But this one is easy for sure. Some of the worst judicial decisions have come from the republican appointed Justices of the Supreme Court. While there might be a difference in where the court errs, it will err all the same unless the justices are strict in interpreting the Constitution. It is a disgusting tribute to the court for instance to note that there hasn't been a 2nd amendment case granted Certiori since 1939 in spite of the fact that there are 20,000 federal laws in effect defying the constitution's admonition: "...shall not be infringed."
Or even worse: "Congress shall make no law ....abridging the freedom of speech."
The Republicans were instrumental in crafting the latest slap in the face - campaign finance "reform." They don't want it struck down by a strict constitutional judge. They want their agenda upheld.
