Why can't Microsoft still restrict access, hide APIs and set up questionable business practices under the guise of protecting "security, anti-virus, licensing, authentication and Digital Rights"?

They can't. But they can do it because of Intellectual Property =). I think that the old arguments of security, etc. are effectively dead now. But the coming up excuses are "intellectual property." Just look at Intel.

Ah, you sound like you know how MS "innovates."

My guess is it will take several more suits and heavier fines to get anywhere near the intent of fair competition for applications.

Don't expect too many new developers rushing to bring real innovation to the market in the meantime.
