I think the court will rule that a second absentee ballot be issued. A copy of the new absentee ballot will be sent to all voters that were mailed the original absentee ballot, whether it's been requested or not. If the voter submits only one ballot - either the new ballot or the old ballot - that ballot will be counted (Wellstone votes will be ignored on the old ballot). If a voter submits both ballots, then only the new absentee ballot will be counted. If a voter shows up at a polling place and votes, all absentee ballots mailed by the user will be voided. Seems fair to me.

That would be the right result, but don't count on it happening.

Sounds like a ready-made recipe for disaster to me. With thousands of ballots out there, what's to keep someone from intercepting the mails and start marking Mondull on every one of them?

if the Court orders this--then they are legislating from the bench--against the Constitution...shades of the NJ Court ruling...and what about the military votes ? A lot of these guys (and gals) vote before they ship out--that's what absentee ballots are for--they may not have a clue about what's going on, and may not be in a place where they will recieve their "new" ballot. Are they going to "delay' the vote certification too ? That opens up the "manufacture as many ballots as we need to win" scenario that New Jersey has...("Hey the Laut is behind by 1,500 votes ?? --oh lookee here ! I just found a WHOLE bunch of uncounted ballots !!)
