If he's firing from inside a van or box truck, that would shield him, and his muzzle flash, from observation from above.

I personally think he's firing a pistol with a long barrel and a scope, and walking away on foot. He doesn't seem to be shooting from an especially great distance, or to be very accurate. Just a hunch, but this possibility never seems to cross anyone's mind.
